This Agreement is a binding contract between 365 Filipino Wishes (“we”, “us”) and you (“you”, “Customer”) for our personalized video greetings, physical products, and related services. By accessing our website or placing an order, you agree to these Terms.

1️⃣ Orders
To place an order, you must provide accurate information, including your name, email, payment details, and any requested photos or messages. For physical products, please double-check sizes and design choices before submitting.

2️⃣ Payments
You agree to pay the fees shown at checkout using valid payment information. Orders are processed once payment is confirmed.

3️⃣ Digital Products (Greetings)
• Each greeting is custom-made by real performers.
• No refunds are provided once a video is completed.
• If we make an error (wrong name, message, or photo), we will redo the video free of charge if you notify us within 7 days.
• If you wish to change any aspect after delivery (music, text), a 50% discounted redo is available once per order, within 7 days.
• All song requests are subject to copyright restrictions. We may refuse or substitute a song request if licensing or copyright issues prevent us from performing it. Videos containing copyrighted music will be delivered privately and will not be posted publicly on our business social media channels.

4️⃣ Physical Products (Gift Shop)
• Physical items are made to order and fulfilled through trusted production partners.
• Please allow 2–5 business days for production plus 3–7 business days for shipping within the USA.
• By ordering, you agree to our [Shipping Policy] and [Refund & Return Policy].
• Returns are only accepted for damaged or defective items — contact us for approval first within 14 days of delivery.
• We are not responsible for delivery delays or damage once the carrier has your package, except as required by law.

5️⃣ QR Series Fair Use
• QR Series hoodies include a 25% lifetime discount; QR Series stickers include a 20% lifetime discount.
• These codes are for personal use by the original owner.
• You may share within your household or with a close friend, but do not resell or publicly post your QR.
• Abuse or mass sharing may result in deactivation of the discount.
5️⃣A. QR Series Lifetime Warranty (Optional Add-On)
• Customers may purchase a Lifetime Warranty for QR Series hoodies and stickers at checkout.
• The warranty covers free replacements for manufacturing defects, damaged QR prints, or premature wear that prevents proper use of the product.
• Warranty does not cover intentional damage, misuse, normal fading/wear-and-tear, or lost items.
• To file a claim, contact us at support@365filipinowishes.com with photos of the item and proof of purchase.
• Warranty claims will be reviewed within 7 business days; approved claims will result in a replacement being shipped at no additional product cost. Standard shipping fees may apply depending on location.

6️⃣ Intellectual Property
You retain ownership of any photos or text you provide. By submitting them, you grant us a non-exclusive, royalty-free license to use them to create your personalized video. We retain rights to all final videos and promotional content. You may share your video for personal, non-commercial use only, including posting it on your own personal social media accounts. However, you acknowledge that platforms may mute, block, or monetize copyrighted music even on personal uploads.
7️⃣ A. Commercial Use Disclaimer
All digital greetings are intended for personal use only. You may not resell, re-edit, or repurpose any part of your video greeting for commercial purposes (e.g., brand promotions, paid campaigns, influencer partnerships, etc.) without our written permission.
If you are interested in commercial or brand collaborations, please contact us first at contactus@365filipinowishes.com for proper licensing and team approval.

8️⃣ Copyright & Social Media Posting
Many songs requested for our personalized videos are protected by copyright. Customers may share their own videos on personal social media accounts for non-commercial purposes. However, 365 Filipino Wishes cannot publicly post videos containing copyrighted music on our business social media channels due to copyright restrictions. Posting to Facebook, Instagram, or TikTok may still result in platforms muting, blocking, or monetizing copyrighted music even on personal uploads.

9️⃣ Social Media Posting Add-Ons
Social media posting of greeting videos is available as an optional add-on. Due to copyright restrictions, videos containing copyrighted music cannot be posted to our business YouTube channel and may still be subject to muting or blocking on other platforms. Social media posting fees are non-refundable. However, if we determine that your video cannot be posted due to copyright restrictions, we will either issue a refund for the social media posting fee or apply the amount as credit toward a future order, at your choice.

We warrant that products and videos will be free of technical defects. We disclaim all other warranties to the fullest extent permitted by law. We are not liable for indirect, incidental, or consequential damages.

You agree to comply with all applicable laws and regulations when using our services, including those related to copyright, privacy, and online conduct.
1️⃣3️⃣ A. Customer Conduct & Respect Policy
At 365 Filipino Wishes, we foster a culture of kindness, respect, and inclusion. By placing an order, you agree to communicate respectfully with our team, refrain from abusive language, and treat all performers and staff with dignity.
We reserve the right to refuse or cancel any order, or to suspend service, if a customer engages in harassment, discriminatory remarks, or repeated disrespectful behavior toward our staff or performers.
1️⃣4️⃣ Promotions and Contests
From time to time, 365 Filipino Wishes may run promotional campaigns, giveaways, or contests (“Promotions”).
These Promotions may include, but are not limited to:
• Free greeting giveaways (e.g., Healthcare Heroes Monthly Giveaway)
• Special raffles
• Travel contests (e.g., Wishes Granted campaign)
Each Promotion will have its own rules and eligibility requirements, provided on the specific campaign page (e.g., giveaway forms, rules pages, or landing pages).
By participating, you agree to these additional rules in addition to our standard Terms of Service.
We reserve the right to modify, suspend, or cancel any Promotion at any time without prior notice, in compliance with applicable laws.

This Agreement is governed by applicable laws without regard to conflicts of laws principles. Any disputes shall be resolved through binding arbitration in English.
1️⃣ 6️⃣ Tips & Gratuities
Tips made through our Tip Jar (Shopify Tip Product or GCash) are entirely voluntary and non-refundable. 100% of tips go directly to our performers, either to the specific individual(s) who fulfilled your order or distributed fairly among the active performer pool. Tips are not considered payments for products or services, and therefore do not qualify for refunds, returns, or credits.
